You (the business) are the data controller for all customer data collected through your use of the Service, including customer names, email addresses, phone numbers, review content, and any other personal information submitted by your customers via LyncScan review forms, QR codes, or related features. LyncScan acts solely as a data processor, processing customer data on your behalf and according to your instructions, solely for the purpose of providing the Service.

You agree to indemnify, defend, and hold harmless EarlyDot Tech Private Limited (LyncScan), its officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your collection, use, storage, or disclosure of customer data; (b) your failure to comply with applicable data protection laws; (c) your failure to obtain necessary consents from your customers; (d) any complaint or legal action brought by your customers or any regulatory authority relating to your data practices; or (e) any breach of your obligations under this section.
The Service, including all content, features, and functionality (including but not limited to software, text, images, graphics, logos, and design elements), is owned by EarlyDot Tech Private Limited or its licensors and is protected by copyright, trademark, and other intellectual property laws.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your internal business purposes. This license does not include any right to modify, reproduce, distribute, or create derivative works of the Service.
Our Service may integrate with or contain links to third-party websites, services, or applications (such as Google Business Profile). These third-party services are not under our control, and we are not responsible for their content, privacy policies, or practices.
Your use of third-party services is subject to their respective terms and policies. We encourage you to review these terms before using such services. We do not endorse or make any warranties regarding third-party services.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EARLYDOT TECH PRIVATE LIMITED AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.
You agree to defend, indemnify, and hold harmless EarlyDot Tech Private Limited and its officers, directors, employees, agents, licensors, and service providers from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your violation of these Terms, your use of the Service, your User Content, or your violation of any law or the rights of a third party.

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.
These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.
These Terms, together with our Privacy Policy and any other legal notices published on the Service, constitute the entire agreement between you and EarlyDot Tech Private Limited regarding the Service.
If any provision of these Terms is held to be invalid or unenforceable, such provision shall be modified to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
Our failure to enforce any right or provision of these Terms shall not be considered a waiver of those rights.
You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.
